Referencing Resolution 2003-31, titled “Restoration and Defense of Constitutional Rights,” the Council emphasized Silver City’s commitment to inclusiveness and the equal protection of all individuals under the law, regardless of their circumstances. The town’s territorial charter does not grant authority to regulate, detain, or engage in matters involving undocumented persons. In keeping with these principles, the town will not devote limited resources to searching for, surveilling, seizing, or detaining undocumented individuals who have not committed a crime under state or local law, nor will it inquire into the immigration status of persons encountered within the community.
