The Department of Homeland Security has waived certain New Mexico water laws for border-wall construction projects in southern New Mexico, allowing specified activities, including well drilling, to proceed without some state requirements. New Mexico officials have raised concerns about groundwater protection and well safety, while federal authorities say the waiver will speed up border construction. The dispute has implications for Hidalgo County and the Bootheel, where groundwater supports ranching and rural communities, and legal challenges remain ongoing.

A review by Source New Mexico found that 589 of the 594 public comments submitted by New Mexico residents opposed the federal proposal to repeal the 2001 Roadless Rule. The rule protects approximately 1.6 million acres of national forest land across the state, including portions of the Gila National Forest, from certain road construction and logging activities. In Southwest New Mexico, changes to these protections could affect wildlife habitat, watersheds, recreation and forest management. While opponents support keeping the existing protections, the U.S. Department of Agriculture says repealing the rule would give forest managers greater flexibility to manage vegetation and address wildfire risks.
